National Apprenticeship Week 2026: Apprenticeship Agreements
Did you know if you give your apprentice the wrong employment contract, you could face significant financial claims if their apprenticeship is terminated?
As it’s National Apprenticeship Week 2026, it’s crucial we remind employers about the importance of regularly reviewing and updating apprenticeship agreements. Apprenticeships are a great way to develop skills and invest in future talent – but only when the correct contractual framework is in place.
Apprenticeship Agreements:
An Apprenticeship Agreement is a legally binding document and sets out the terms and conditions of the apprenticeship. It is important that both the employer and apprentice understand and agree to the terms of the agreement before it is signed.
A compliant Apprenticeship Agreement should clearly set out:
- The skill, trade, or occupation the apprentice is being trained for,
- The name of the apprenticeship they’re working towards,
- The start and end dates for the apprenticeship,
- The amount of training you’ll give them,
- The working conditions, pay, and hours,
- Details on how and when the apprenticeship could end, known as the termination clause, and
- Any additional obligations.
Risk of Using the Wrong Contract:
One common mistake employers make is issuing an apprentice with a standard employee contract, rather than a dedicated Apprenticeship Agreement.
If an apprentice is not provided with an Apprenticeship Agreement, employers may unintentionally create a common law apprenticeship. In the event you dismiss the apprentice, for any reason, you could face potential damages claim, which is valued upon:
- Loss of earnings for the remainder of the apprenticeship,
- Loss of future career prospects
A Timely Reminder for Businesses:
National Apprenticeship Week provides an ideal opportunity for employers to ensure their Apprenticeship Agreements are up to date and legally compliant. We recommend that businesses take time to:
- Review existing apprenticeship contracts,
- Check that apprenticeship agreements meet current legal requirements,
- Ensure training arrangements are clearly documents, and
- Seek advice where documentation is outdated or unclear.
Taking proactive steps to ensure compliance can help prevent disputes and protect your business.
